13.12.2021 sl.14,sk ct.29 C.R.R.806 of 2010 CRAN/1/2010(Old No. CRAN 1542/2010) (Application not here) In the matter of Arabinda Biswas & Ors. .....petitioner. Mr. Binay Kumar Panda Mr. Pravas Bhattacharyya ...for the State.

None appears on behalf of the contesting parties to the revisional application.

Mr. Binoy Kumar Panda along with Mr. Pravas Bhattacharyya, learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Public Prosecutor is requested to regularize the appointment of Mr. Binoy Kumar Panda and Mr. Pravas Bhattacharyya learned advocates in due course. The learned Advocate on behalf of the State appears and submits that the instant revisional application is not directed against the particular order rather against the chargé-sheet itself submitted by the police.

It is also submitted that after 19th March, 2010, the petitioner took no steps and he was also directed to serve copy of the other side and to file affidavit of service. No step was taken on behalf of the petitioner since 19.3.2010.

This revisional application was directed against the charge-sheet itself filed submitted by the Sub-Inspector of Memari Police Station in connection with the Memari Police Station Case No. 197/2007 dated 16.8.2007 in connection G.R.Case No. 1052/2007 is pending before the Chief Judicial Magistrate at Burdwan. It was an option before the petitioner to wait till consideration of charge by the court but this revisional application was filed against the charge-sheet itself before consideration by the court after its submission. In view of the aforesaid matter, I find no reason to continue with this revisional application further while the petitioner is taking no step till 19.3.2010.

Thus, the revisional application stands disposed of accordingly.
