Ashish Kumar v. State Of West Bengal & ANR
12.12.2022 Court No.35 Item No. 33 I.T CRR 692 of 2015 With CRAN 1 of 2015 (Old No: CRAN 1843 of 2015) Ashish Kumar Vs.
State of West Bengal & Anr.
None appears on behalf of the parties. This matter is pending in the list since 10.11.2022 and has been called on each day of working of this court since that date. Inspite of that no one is appearing. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit.
Petitioner has come up to pray for quashing of the entire proceeding against him pursuant to Nimta Police Station Case No. 177 dated 22.10.2010 under Sections 406/420/323 IPC, corresponding G.R Case No. 4140/10. After completion of investigation in the case the police has submitted charge sheet. The crux of allegations is entering into by both the parties in an agreement for telecast of content of channel for which transaction of money has also taken place. However, allegedly the terms of agreement were violated to be termed as cheating caused by the petitioner upon the defacto complainant. On perusal of the entire materials available on record and the grounds made up by the petitioner I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this court's interference into the impugned order.
Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 692 of 2015 is dismissed. In view of dismissal of this revision the connected application being CRAN 1 of 2015 (Old No: CRAN 1843 of 2015) is also dismissed. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
