Petitioner has made an application for transfer in offline mode on 4th January, 2025 on the ground of distance in between the present school of the petitioner and his place of residence. It is submitted that transfer application of the petitioner is yet to be decided.

Respondents are represented by learned advocates.

It is submitted on behalf of the District Primary School Council, Malda that in the event concerned authority is directed, transfer application of the petitioner shall be decided in accordance with law. Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing Chairman, District Primary School

Council, Malda being respondent no.4 to decide the transfer application of the petitioner by six weeks from date of communication of this order.

The decision to be taken by the respondent no.4 shall be communicated to the petitioner by ten days thereafter.

However, it is made clear that suspension of Utsashree portal shall not be a ground for rejecting the transfer application of the petitioner.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
