Matter relates to transfer of the petitioner from one primary school to another in the same district. Petitioner first made an application for transfer on Utsashree portal on 18th February, 2022 which was not considered by the Sub-Inspector of Schools which prompted the petitioner to prefer an offline application dated 12th March, 2025.

The grievance of the petitioner is in spite of preferring offline application seeking transfer on the ground of distance in between the present school of the petitioner and his place of residence till date no decision has been taken by the concerned respondent authorities.

Respondents are represented by learned advocates.

It is submitted on behalf of District Primary School Council, Malda that in the event direction is given upon the concerned authority, transfer application of the petitioner shall be decided in accordance with law.

Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing Chairman, District Primary School Council, Malda being respondent no.4 to decide the transfer application of the petitioner dated 12th March, 2025 by six weeks from the date of communication of this order.

The decision to be taken by the respondent no.4 shall be communicated to the petitioner by ten days thereafter.

However, it is made clear that suspension of Utsashree portal shall not be a ground for rejecting the transfer application of the petitioner.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
