No. 29 KAUSHIK REJECTED C.R.M.(A) 1291 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Dubrajpur Police Station Case No. 122 of 2019 dated 01.06.2019 under Sections 15(c) of the Narcotic Drugs and Psychotropic Substances Act.

And In Re : Sekh Firoj ...... petitioner Mr. Angshuman Chakraborty ....for the petitioner Mr. Arijit Ganguly Mr. Sanjib Kumar Daan ....for the State The police case is dated June 1, 2019.

Commercial quantity of narcotic was recovered from the house belonging to the petitioner.

In view of the long absconsion of the petitioner and in view of the recovery as noted, the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1291 of 2023 is dismissed.
