Petitioner drew the attention of the Court to the order dated 13.12.2024 in WPA 29506 of 2024 pursuant to which petitioner approached the learned ACJM, Alipore and, accordingly, Golf Green P.S. Case No.31 dated 15.02.2025 has been registered for investigation under the relevant provisions of BNS. Petitioner's main grievance now is that there has been no progress in the investigation and he is also not allowed to enter at his residence.

Learned advocate appearing for the State submits a report. Report reflects that pursuant to the directions passed by the learned ACJM, Alipore, cases have already been registered, documents have been collected from the concerned Rehabilitation Centre being the Genesis Foundation, statements have been

recorded, the history of the petitioner has also been recorded and necessary notices under Section 35(3) of the BNS have been issued against the accused persons. Since the facts were in detail stated in the application under Section 175(3) Cr.P.C., the notice under Section 94 of BNSS has not been issued upon the complainant till date but the same would be issued in due course, if required. Steps are being taken by the police authorities to arrive at a conclusion.

Having considered the steps taken by the police authorities, at this stage, I do not find any reason to interfere with the progress of the investigation in respect of a case which has been registered on 15th February, 2025. However, police authorities would put in efforts and take the investigation of the case to its logical conclusion within a reasonable period of time.

With the aforesaid observations, WPA 7309 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
