Petitioners have challenged the continuance of English Bazar Police Station Case No. 659 of 2022 dated 28.04.2022. The investigating agency on conclusion of investigation has submitted charge-sheet under Sections 341/323/ 325/354/506/34 of the Indian Penal Code.

I have considered the materials so enclosed along with the revisional application and also taken into account the stage of the proceedings before the learned trail court. Having considered the same, I grant liberty to the petitioners to prefer an application under Section 239 of the Code of Criminal Procedure. The learned Magistrate would take into account the contentions advanced by the petitioners and independently decide on the issue relating to prayer for discharge without being influenced by any observations made by this Court while disposing of the present revisional application.

With the aforesaid observations, the revisional application being CRR 1186 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
