The instant appeal is barred in limitation by 355 days. An application under Section 5 of the Limitation Act was filed on behalf of the appellant but none moves the said application. The appellant takes no step when the matter is called for hearing. In view of the fact that the instant appeal is barred by limitation and the delay has not been condoned, the application under Section 5 of the Limitation Act is rejected.
