In terms of order dated 8th April, 2025, report of the District Inspector of Schools (SE), Hooghly dated 28th April, 2025 is filed and same is taken on record.
On perusal of the report dated 28th April, 2025, it appears that petitioner took transfer from Telinipara Mahatma Gandhi Vidyapith High School (HS), Hooghly (hereinafter referred to as "said school") and joined Kanchrapara Janata High School (HS), North 24 Parganas on 1st August, 2024. It is further stated in the report that after transfer of the petitioner said school authority updated service book including leave register and requested the petitioner vide
email dated 14th December, 2024 to put her signature at the relevant pages of the service book for sending the same to her present school after countersigning by the Additional District Inspector of Schools (SE), Chandannagore. It is also stated that petitioner refused to sign in the service book on the plea that there were certain errors in the service book. Subsequent thereto, said school authority rectified the errors as pointed out by the petitioner and requested the petitioner to sing in certain pages of the service book when petitioner demanded other documents including Managing Committee resolutions which said school is not supposed to make over due to transfer of the petitioner from said school to another school.
Since it emanates from report dated 28th April, 2025 that said school authority has already updated the service book of the petitioner and other service records which are required to be transmitted to the present school of the petitioner are also made ready, Teacherin-Charge of said school is directed to submit updated service book and other relevant documents in the office of the District Inspector of Schools, Hooghly being respondent no. 3 by seven days from date.
Petitioner shall also be at leave to receive service book and other documents which will be submitted in the office of respondent no. 3 by said school authority by fortnight after putting due signature as per requirement and those documents are to be countersigned by the competent Sub-Inspector of Schools working under respondent no. 3 and to be handed over to the petitioner when the petitioner will attend the office of respondent no. 3.
If salary for the month of August, 2024 remained unpaid till date, respondent authorities shall release the same in accordance with law in favour of the petitioner by four weeks thereafter.
Writ petition stands disposed of.
