His appointment may be regularised by the concerned authorities. Learned advocate for the petitioner expresses anxiety as the petitioner is aged about 60 years and is in custody since 23.05.2022.

It is submitted that out of 7 witnesses so cited by the prosecution 2 witnesses have already been examined and the next date has been fixed on 3rd August, 2023. Having considered the fact that the petitioner is in custody, the learned trial court is directed to fix a schedule of 3 dates and fix such schedule within a reasonable period of time so that trial can be concluded at the earliest. No unnecessary adjournment should be granted to either of the parties.

Learned Public Prosecutor conducting the case would produce the documents, materials and exhibits on the date fixed for examination of the witnesses. In case any witness belonging to the government department is absent, learned trial court would directly send notice to the superintendent of police of concerned district for production of the said witness.

With the aforesaid observations, CRR 1135 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.
