The petitioner complains of non-consideration of her prayer for compensation on account of death of her husband, due to electrocution. It is alleged that a live electric wire maintained by the distribution company, had caused such accidental death. The village of the petitioner is Paschim Surendra Nagar. Dr. Saha Roy, learned advocate appearing on behalf of the WBSEDCL, submits that the distribution company is not responsible for the death of the petitioner's husband.
The writ petition is disposed of without any opinion on the correctness of the contentions of the petitioner. The writ petition shall be treated as a
representation of the petitioner and disposed of by the concerned authority in accordance with law.
The petitioner and the representative of Patharpratima Customer Care Centre shall also be heard at the time of disposal of the writ petition. A reasoned order shall be passed and communicated to the petitioner. The entire exercise should be completed within a period of two months from the date of communication of this order.
Since no affidavit has been called for, allegations made in the writ petition are deemed to be denied by the distribution company. The distribution company shall be entitled to put forward their version before the appropriate authority along with documents. There shall be no order as to costs. All parties are to act on the basis of server copy of this order. (Shampa Sarkar, J.)
