Mr. Sajal Kanti Bhattacharyya ...for the petitioner This is an application wherein petitioners have prayed for expeditious hearing of G.R. Case No.784 of 2020 presently pending before learned Judicial Magistrate, 3rd Court, Hooghly. Learned Counsel for the petitioners submits that the prosecution only proposes to examine four witnesses but till date not a single witness has been examined and since 30th October, 2022 no improvement in trial has taken place and the Court below is fixing consecutive dates for evidence. Therefore, he prayed for appropriate direction upon the Court below.

Having heard learned Counsel for the petitioners, it appears that the prayer made by the petitioners is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, the service of copy of application upon the opposite party is dispensed with.

Having heard learned Counsel for the petitioners and that the prayer made by the petitioners is justified, the instant application being CRR 1418 of 2026 is hereby disposed of with a direction upon the Court below to make its best endeavour to expedite the trial and to make his best effort to conclude the trial preferably within a period of 6 months from the next date of hearing.

This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
