Ct. 05 Item No.19 04.05.2022 (suvendu) WPA 7017 of 2022 Samiran Maity Vs.

The State of West Bengal & Ors.

Mr. Anil Kumar Chattopadhyaya .........for the petitioner Mr. Swapan Kumar Dutta Mr. Dipankar Dasgupta .......for the State Ms. Debjani Sengupta Ms. Koyel Bag Ms. Shahina Haque Ms. Shreya Bhattacharjee Mr. Abhijit Chatterjee ........for the respondent nos. 2 & 3 The affidavit of service is taken on record.

The petitioner is aggrieved by a letter of termination dated 19.07.2021 by which the petitioner has been terminated from the post of Junior Peon at the concerned University with immediate effect.

The only prayer of learned counsel appearing for the petitioner is for a direction on the University to consider the representations made by the petitioner from 27.08.2021 onwards.

Learned counsel appearing for the University hands up a communication dated 13.04.2022 which

states that the petitioner's representation of 27.08.2021 has been considered and the petitioner's prayer for joining the post of Junior Peon has been declined. The said letter is kept on record. Since the petitioner's representation has already been responded to by the University, nothing further remains in the writ petition which is accordingly dismissed.

The letter of the University in any effect raises a fresh cause of action for the petitioner to file fresh proceedings.

Counsel submits that the petitioner has not received the University's letter till date. The University is directed to communicate the said letter to the petitioner by tomorrow, i.e. on 05.05.2022, if not already communicated.

WPA 7017 of 2022 is dismissed in terms of the above without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
