Grievance of the petitioner is a piece of land was donated for construction of school but said land was not utilized as a result whereof prayer is made for return of such unused land. It is submitted that petitioner has preferred a representation praying for demarcation of the land in question.

District Primary School Council, Purulia is represented by learned Additional Government Pleader.

Considering the submissions made on behalf of the petitioner, it appears that issue involved in this writ petition is purely civil in nature.

Therefore, in order to protect right of the petitioner mandamus cannot be issued.

Hence, writ petition stands dismissed.

However, this order shall not preclude the petitioner to take steps in accordance with law by approaching civil court.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
