Mr. Arijit Ganguly .....For the State The Court is approached under Section 482 of the Code of Criminal Procedure soliciting the direction to ensure expeditious disposal of a pending NDPS Case of Learned Additional District and Sessions Judge (Special Court of N.D.P.S. Act), Barrackpore, North 24 Parganas vide Case No. N-54/19 under Section 21(c) of the N.D.P.S. Act.

Having considered the submission of the learned advocate for the petitioner revealing the inordinate delay caused in the commencement of the trial, for the petitioner being in custody, and the submission of the learned advocate for the State stating the progress of the case, the Court is of the view that the instant revisional application may be disposed of, so as to subserve the purpose of justice giving direction mentioned as hereunder:- Learned Court below is directed to frame charge either on the stipulated date fixed for the purpose, or for any reasons whatsoever the same could not be done, the charge may be framed within one month thereafter peremptorily providing sufficient opportunity of hearing to either of the parties to this case with an aim to

ensure expeditious disposal, if necessary upon resorting the steps available under Section 309 of the Code of Criminal Procedure.

With these directions and observations, the revisional application is disposed of.
