Being aggrieved by an order of dismissal dated October 8, 2024 passed by the Boarder Security Force Authority, the petitioner has already preferred an appeal under Sub-Section (2) to Section 117 of the Boarder Security Force Act, 1968 read with Sub-Rule (2) to Rule 167 of 1969 Rules. The appeal annexure p-10 at page-150 still pending before the jurisdictional appellate authority. In view of the above, the jurisdictional appellate authority after granting an opportunity of hearing to the parties thereto and by passing a reasoned order therein shall dispose of the appeal

positively within a period of six weeks from the date of communication of this order.

It is made clear that, this Court has not gone into merits of the claims and rival claims of the parties and the appellate authority shall decide the appeal independently in accordance with law without being influenced by any observation made by this Court.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations and directions, this writ petition, WPA 7498 of 2025 stands disposed of, without any order as to costs.
