Learned counsel for the petitioner contends that, due to resistance created by the private respondent, the West Bengal State Electricity Distribution Company Limited (in short 'WBSEDCL') is not being able to give a new electric connection to the petitioner as per the petitioner's application.

Learned counsel appearing for the WBSEDCL contends that, even apart from the private respondent no. 6, several other people have been obstructing and have given written objections to the petitioner getting an electric connection to the premises.

Since the law is very clear on the subject and the matter has to be referred to the District Magistrate for deciding on the objections, if raised, to a new

connection, WPA 8374 of 2021 is disposed of by directing the WBSEDCL to refer the matter pertaining to the objections raised against the petitioner's application for new connection to the concerned District Magistrate at the earliest, preferably within a week from date. If so referred, the District Magistrate is expected to dispose of the matter as expeditiously thereafter as the roster of the District Magistrate permits.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
