1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Petitioner is aggrieved by the manner investigation which is being carried out by the investigating agency in Golabari Police Station Case No. 16 of 2026 dated 19th January, 2026. At the same time, prayer is made for recovery of gold ornaments and valuable streedhan articles of the petitioner.

3) State respondents and private respondents are represented by learned advocates.

4) It is submitted on behalf of the private respondents that if petitioner is aggrieved due to failure on the part of the investigating agency to recover gold ornaments

in that event petitioner is to approach subordinate court and present writ petition is not maintainable.

5) Learned advocate representing the State respondents has filed a communication dated 5th April, 2026 of Officer-in-Charge of Golabari Police Station, Howrah Police Commissionerate and same is taken on record. Copies of said communication are made over to learned advocates representing the petitioner and private respondents.

6) It is disclosed in said communication that on conclusion of investigation a charge-sheet being no. 45 dated 22nd February, 2026 was submitted before the jurisdictional Magistrate under Section 85 of the Bharatiya Nyaya Sanhita, 2023 and sections 3 /4 of the Dowry Prohibition Act.

7) Since charge-sheet has already been filed it appears that prayer (a) of the writ petition becomes infructuous.

8) Furthermore, prayer for recovery of gold ornaments and valuable streedhan articles as couched in prayer (b) of the writ petition at this stage needs to be agitated before the subordinate court.

9) With the aforesaid observations, writ petition stands disposed of.

10) There shall be no order as to costs.

11) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
