No. 29 CHC Rejected C.R.M.(A) 993 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Cyber Police Station, New Delhi, F.I.R. No.07 of 2024 dated 14/02/2024 under Sections 419/420/120B of the Indian Penal Code, 1860 along with Section 66(D) of the Information Technology Act, 2000.

And In the matter of : Bapi Roy ...... petitioner Mr. Indradeep Pal, Mrs. S. Pal Das ....for the petitioner Mr. Bitasok Banerjee ....for the State Petitioner prays for transit anticipatory bail. The allegations as against the petitioner are serious. Apparently, petitioner is involved in a cyber crime where, money in excess of Rs.18 Lakhs was siphoned off. Grant of transit anticipatory bail will unnecessarily create avoidable hurdle in the investigation.

We are of the view that attempt to secure transit anticipatory bail is a ruse to circumvent the investigation, if possible.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.
