Learned advocate appearing for the petitioner submits that the petitioner is a citizen of Indian. He refers to the various documents. He refers to the order of the jurisdictional Court and submits that despite the Investigating Officer being asked to submit a report, such report was not submitted.

Learned advocate appearing for the State draws the attention of the Court to the materials in the case diary. Considering the nature of the proceeding against the petitioner it would be inappropriate to decide the issue as to whether the petitioner is a foreigner or not on a petition seeking bail.

In the circumstances, we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is rejected.

CRM (DB) 1056 of 2022 is dismissed.
