The petitioner has been charged with commission of offence punishable under Sections 354A/323/376(2)(i)(n)(f)/506 of the Indian Penal Code read with Sections 8 and 10 of the POCSO Act.

The victim girl was six years old at the time of the incident. We have seen the statement of the victim girl recorded under Section 164 of the Code. We have also considered the medical report. Although there may not be any external injury, the same need not always be there. The statement of the victim girl is vivid and clear.

The petitioner says that he has been in custody for 414 days and there is no real likelihood of the trial being concluded at an early date.

Having considered the material in the case diary and the nature and gravity of the offence that the petitioner has been charged with, we are not inclined to allow the prayer for bail of the petitioner, at this stage.

The prayer for bail stands rejected.

Accordingly, C.R.M. No.2960 of 2021 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Suvra Ghosh, J.) (Arijit Banerjee, J.)
