15.01.2021 SL No.21 wt 22 Court No.12 (gc) CPAN 751 of 2020 Dr. Santanu Tathagata Pal Vs.

Prof. (Dr.) Rajendra Pandey & Ors.

In MAT 449 of 2020 (Via Video Conference) Mr. D.N. Roy, Mr. Biswarup Nandy, ...for the Applicant.

Mr. Siddhartha Banerjee, Mr. Debakinandan Maity, ...for the Alleged Contemnors.

The alleged contemnors are represented by Mr. Siddhartha Banerjee with Mr. Debakinandan Maity. Mr.

Banerjee has produced before us a communication dated 14th January, 2021 wherefrom it appears that the applicant in spite of repeated intimations did not attend the University within 12th January, 2021. However, one letter was issued on behalf of the applicant questioning certain jurisdictional issue. The fact remains that the subsistence allowance has not been paid in the communication. We find that the two-fold ground are taken for not releasing the subsistence allowance are:- i) absence of bank details;

ii) the calculation and release of subsistence allowance, as per existing Government norms, is in progress.

We expected that today the alleged contemnors would furnish us the calculation of the amount payable to the applicant towards subsistence allowance.

The learned Counsel representing the alleged contemnors is unable to inform this Court about the admissible amounts payable towards subsistence allowance. We give another opportunity to the alleged contemnors to comply with this order, failing which, we shall issue rule against the alleged contemnor for his past conduct for not complying with report.

Let this matter be listed on 4th February, 2021 when the Registrar of West Bengal University of Health Sciences should be present personally with the compliance report. The communication dated 14th January, 2021 be kept with the record.
