The present application under Article 227 of the Constitution of India is at the instance of the plaintiff in a suit for declaration and permanent injunction being Title Suit No.10 of 2014 pending before the 2nd Court of Learned Civil Judge (Junior Division) at Asansol, District-Paschim Burdwan.
The grievance of the petitioner is that the suit although was fixed for ex-parte argument in the year 2019 but till date same has not been disposed of.
The petitioner, by the present application, is praying for a direction upon the learned Trial Judge for expeditious disposal of the said suit. It appears from the records that the suit is proceeding ex-parte against the defendants and on August 28, 2019 vide Order no. 37, the exparte argument of the suit was fixed on December 02, 2019.
Therefore, at this stage, there cannot be any plausible reason to defer the disposal of the said suit any further.
The learned Trial Judge is requested to dispose of the said suit as expeditiously as possible, preferably within available six effective working weeks of the Court below from the date of communication of this order.
C.O. 817 of 2021 is disposed of with the above terms without any order as to costs.
