Learned counsel for the petitioner contends that the petitioner is entitled to a new and separate electricity connection in his own name, in view of the petitioner being a tenant in respect of the premises.

However, by placing reliance on the relevant provisions of Regulation Nos. 53 and 56 framed by the West Bengal Electricity Regulatory Commission, learned counsel for the CESC submits that, even though the petitioner may be entitled to such electricity connection, the objection taken by the CESC Limited in the present case pertains to the apprehended splitting of load in the event a new connection is given to the petitioner, since the petitioner is already enjoying an electricity connection at the premises, which stands in the name of some other consumer.

It is further contended by the CESC Limited that an imminent risk of accident an electrical hazard/fire hazard

is also apprehended in the event a new connection is given at the same premises, in the name of the petitioner. However, it is evident from the Regulations governing the present issue that the appropriate forum for deciding the dispute in respect of splitting of load and the other objections taken by the CESC Limited is the Grievance Redressal Officer.

Hence, WPA 7045 of 2022 is disposed of by granting liberty to the petitioner to approach the concerned Grievance Redressal Officer with the dispute as raised in the present writ petition.

If so approached, the GRO shall decide the same in accordance with law upon giving adequate opportunity of hearing to all concerned as expeditiously as possible, preferably within eight weeks from the date of reference. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
