Learned advocate appearing for the petitioner is aggrieved by the manner in which the complaint case being C. Case No.568 of 2021 is progressing before the learned Judicial Magistrate, 8th Court, Alipore. The said proceedings is under the relevant provisions of the PWDV Act. Petitioner is the wife and she submits that her application under Section 23 of the PWDV Act till date has not been disposed of. Learned advocate further submits that although the present petitioner has filed her affidavit of assets and liabilities but till date the private opposite parties have not filed their affidavit of assets and liabilities. It has been informed that the next date is fixed on 25th April, 2024.

Learned Judicial Magistrate, 8th Court, Alipore is directed that if on 25th April, 2024 the private opposite parties do not file their affidavit of assets and liabilities, the learned trial court would grant them another 15 days' time to file their affidavits and dispose of the application under Section 23 of the PWDV Act by 30th April, 2024. Thereafter, the learned Magistrate would fix one date in a month for the trial of the present case so that the whole proceedings

can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, CRR 1191 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
