The petitioner is aggrieved by the manner in which the police authorities have acted and submits that the daughterin-law by usurping the process of law activated the police authorities in a manner thereby depriving the present petitioner being the mother-in-law from her residential rights.

Learned advocate for the State submits a report and stated that the

police authorities have acted pursuant to the directions of the Hon'ble Court and whole of the process which has been complained of including breaking of the padlock has been videographed which has been enclosed by way of a compact disc.

Learned advocate for the private respondents, on the other hand, submits that an appeal is preferred before the learned Additional Sessions Judge, Ranaghat under Section 29 of the PWDV Act.

The petitioner has already preferred an application before the SDO under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The hearing of the said application has been completed and the next date has been fixed by the SDO in the month of May, 2025.

Having considered the contentions advanced by the learned advocates for the

petitioner, private respondent(s) as also the State, I am of the view that the police authorities have acted pursuant to the directions of a Court of law. If merits of the issues are to be canvassed, the same will be adjudicated by the statutory court(s) and/or by the authorities, the police authorities have no option to interfere as they have respected, obeyed and implemented the order of a court of law.

In view of the issues pending before the learned jurisdictional appellate court as well as the jurisdictional authority, I am of the view that the concerned court and/or the authority would, as expeditiously as possible, dispose of the same within a scheduled period of time.

With the aforesaid observations, WPA 7413 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record.
