The claim of the petitioner is that he applied for obtaining FPS dealership on 29th October, 2014 in respect of the vacancy at Kankra, Paschim Midnapore. The petitioner was directed to submit the documents in support of his candidature by the SubDivisional Controller (Food and Supplies), Kharagpur by a communication dated 16th October, 2014. An enquiry as regards the engagement of M.R. dealer against the vacancy at Kankra under Debra Block was conducted in November, 2014.
Since thereafter the petitioner time and again visited the office of the respondent authorities for taking information as regards the fate of his application. The petitioner claims that he was assured that as and when his application will be considered he will be intimated accordingly.
The petitioner submits that along with his application there were several other applications filed by candidates who were residing outside the Kankra region. According to the petitioner he was the only
candidate from Kankra region to file the application for filling up the vacancy at Kankra.
The petitioner all on a sudden in March, 2021 got the information that applications have been invited online on 6th March, 2021 and the time to file the application was over on 12th March, 2021. The petitioner immediately made a representation before the respondent authorities praying for permission to participate in the selection process. The said representation was sent through speed post on 16th March, 2021. There is no response to the representation made by the petitioner. As the State respondents are unrepresented the Court is not in a position to decide the matter finally on merits.
Accordingly, the instant writ petition is disposed of by directing the Sub-Divisional Controller, Food & Supplies, Kharagpur, Paschim Midnapore to intimate the petitioner the fate of his earlier application.
In the event, the application of the petitioner stood cancelled for any reason whatsoever the said respondent shall also consider the prayer of the petitioner for participating in the selection process that is in progress at present. The aforesaid respondents shall also take into consideration the
prayer of the petitioner for participating offline in the selection process.
The petitioner is directed to forward all the necessary documents in support of his case to the aforesaid respondent at the time of communicating the order of the Court.
The aforesaid respondents shall pass a reasoned order at the earliest, but positively within a period of four weeks from the date of receipt of all documents from the petitioner.
The writ petition stands disposed of.
