Mr. Soumalya Ganguli, learned advocate appears on behalf of the appellant and submits that his client is not willing to proceed with the present appeal as the matter has already been settled between the parties.

In view of the aforesaid, F.M.A.T. (M.V.) 176 of 2022 is dismissed as not pressed without any order as to costs.

The interim order, if any, stands vacated.

The appellant is permitted to withdraw the statutory deposit of Rs.25,000/- (Rupees Twenty five Thousand Only) deposited in this appeal with the learned Registrar General of this Court on April 20, 2022 in accordance with law.

In view of the dismissal of the appeal, the connected application being CAN 1 of 2022 is also dismissed.
