This special leave to appeal under Section 378(3) of the Code of Criminal Procedure is filed with a prayer for leave to file appeal against the judgment and order of acquittal dated 17th October, 2023 passed by the learned Judge, Special (CBI) Court No.2, Bichar Bhawan, Kolkata, in connection with Special Case No.38 of 2011 wherein the learned Judge acquitted the accused/respondent from the charge under Sections 13(1)(d)/13(2) of the Prevention of Corruption Act, 1988 read with Sections 420/465/468/471/120B of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner/appellant has submitted that the opposite party/respondent misused his official power and tampered the deposit application form and thereby causes loss to HUDCO more than Rs.18,00,000/-.

Having heard the learned advocate on behalf of the petitioner/ appellant on the ground of appeal and also having gone through the judgment impugned, leave is granted.

The petitioner/appellant is at liberty to prefer an appeal within the statutory period.

With the aforesaid observation, CRMSPL 28 of 2024 stands disposed of.
