The petitioner's application for transfer on medical grounds was not approved by the head of the institution. It was kept in abeyance on the ground of his seniority amongst the applicants. Since, it is well settled that an application for transfer on medical ground is not restricted by reason of seniority or otherwise, the head of the institution shall verify the medical condition of the petitioner within 10 days from date from BMOH and take suitable steps based on such medical opinion in accordance with the 2015 Rules.

For the aforesaid purpose, the petitioner shall be entitled to file afresh. The earlier application shall stand cancelled and/or returned.

With the aforesaid directions, the instant writ petition is disposed of.

There will be no order as to costs.
