Petitioner prays for transfer on medical ground since petitioner is suffering from gynecological disorder as it is submitted by learned advocate representing the petitioner.
Petitioner made an application for transfer on Utshasree portal. Grievance of the petitioner is though transfer application is lying in the office of the District Primary School Council, Jhargram same has not been decided till date.
It is submitted on behalf of the District Primary School Council, Jhargram that if direction is given upon the concerned authority, transfer application of the petitioner shall be decided in accordance with law.
Having considered the submissions made on behalf of the parties, Court directs the concerned authority of the District Primary School Council, Jhargram to obtain medical report from the concerned Chief Medical Officer of Health/ Medical Board on medical examination of the petitioner by four weeks from date of communication of this order. In the medical report concerned Chief Medical Officer of Health/ Medical Board is required to opine nature of ailment of the petitioner is such, petitioner is required to avoid long distance journey. If medical report justifies transfer of the petitioner, concerned authority of the District Primary School Council, Jhargram shall decide transfer application in accordance with law by four weeks thereafter. Decision to be taken shall be communicated to the petitioner by ten days thereafter.
Writ petition stands disposed of, without any order as to costs.
However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
