1. We have heard the learned counsel appearing for the parties.

2. The appeal is arising out of the order dated 18th February, 2008 passed in the writ petition in which a prayer was made for a direction upon the District Project Officer, S.S.M, Murshidabad to rescind the order containing the Memo dated 4th January, 2008 on several grounds.

3. It appears from the order of the District Project Officer, S.S.M, Murshidabad that the case of the petitioner could not be considered as she had applied at two schools for being appointed as additional para teacher in the year 2006 which is violation of the vires that the writ petitioner applied for two schools. The same has been admitted by the husband of the writ petitioner.

4. Under such circumstances, we do not find

any reason to interfere with the order passed by the learned Single Judge.

15. On such consideration, the appeal fails.

16. In view of the aforesaid order the appeal being MAT 208 of 2008 stands dismissed.

17. In view of the dismissal of the appeal nothing remains to be decided in the application being CAN 11554 of 2014 and the same is accordingly dismissed.

However, there shall be no order as to costs.
