13.04.2023 Court No.35 Item No. 43 D.Hira CRR 939 of 2016 Himadri Sekhar Ghosh @ Himadri Ghosh Vs.

The State of West Bengal & Anr.

Mr. Pravas Bhattacharyya, Mr. Mirza Firoj Ahmed Begg.

... for the State None appears on behalf of the petitioner. This matter is pending in the list since 20.03.2023 and has been called on each day of working of this Court since that date. In spite of that no one is appearing on behalf of the petitioner. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit. Petitioner by filing this case has challenged the criminal proceedings against him in connection with Uluberia Police Station Case No. 815 dated 02.11.2015 under Sections 498A/323/506/34 of the Indian Penal Code, corresponding to G.R. Case No. 2464 of 2015, now pending in the Court of Additional Chief Judicial Magistrate at Uluberia, Howrah.

Petitioner says that the FIR as well as the other materials has not made out any case against him or any cognizable offence has not been disclosed. This has laid him to pray that proceeding against him in this case would be an abuse of the process of Court. Thus, he has prayed for quashing of the said proceeding.

On perusal of the entire materials available on record and the grounds made up by the petitioners I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 939 of 2016 is dismissed.

All pending applications, if any, are consequently disposed of. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
