Learned advocate representing the petitioner submits that petitioner's father was a Group -D staff of a Government aided Higher Secondary school who died-in-harness on 11th December, 2023. Application was made in time seeking appointment on compassionate ground based on which District Inspector of Schools (SE), Hooghly being respondent no. 3 by issuing memo dated 24th April, 2024 requested the petitioner to submit certain documents. It is submitted that pursuant to this memo dated

24th April, 2024 petitioner submitted those documents before the concerned school authority and the Teacher-in-Charge of the school in his turn vide letter dated 24th June, forwarded relevant documents to respondent no. 3 for taking decision.

Grievance of the petitioner is till date respondent no. 3 has not decided the application of the petitioner seeking appointment on compassionate ground.

Respondents are represented by learned advocates.

It is submitted on behalf of State respondents that since issue is pending before respondent no. 3 same needs to be decided in accordance with law.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing respondent no. 3 to decide the application of the petitioner seeking appointment on compassionate ground by six weeks from date of communication of this order after granting opportunity of hearing to the petitioner or his representative. Respondent no. 3 shall pass reasoned order and same shall be communicated to the petitioner by seven days thereafter.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
