1. This writ petition has been filed as a public interest litigation seeks for a direction upon the Special Officer of the Malda District Central Cooperative Bank to immediately suspend and take appropriate legal action against the private respondents.

2. Earlier a writ petition was filed as a public interest litigation in W.P.A.(P) 576 of 2023 by the very same writ petitioner viz. Sudhir Kumar Ghosh, which was, in fact, the second writ petition, wherein the petitioner sought for implementation of the directions issued by the Registrar of Cooperative Society, West Bengal dated 22nd August, 2023. The said writ petition was disposed of when an order has been passed by the

appropriate authority, as directed in the order dated 22nd August, 2023. The entire exercise has to be completed within a period of three months.

3. The learned advocate for the respondent/State has produced a copy of the Memo dated 16th April, 2024 addressed by the Chief Executive Officer of the Malda District Central Cooperative Bank Ltd. to the Additional Registrar of Cooperative Societies (Law), Cooperation Directorate, West Bengal.

4. The said Memo, in fact, is an action taken report. Therefore, action has been taken pursuant to the enquiry, which was conducted and it is up to the authorities to proceed further in accordance with law.

5. With the aforesaid observations, the writ petition stands disposed of.

6. No costs.

7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
