In view of the fact that the Government of West Bengal School Education Department has withdrawn the recommendation for transfer in terms of the Notification of the Department being No-216/SE/S/10M09/2023 dated 10th February, 2023 towards rationalization of teachers working in recognized non-Government aided/sponsored Upper Primary/Secondary/Higher Secondary Schools, the impugned order of recommendation has lost its force. The petitioner/appellant, accordingly, cannot be transferred on the basis of the recommendation made earlier under Section 10C of the Notification No.605 DSE-

12099/8/2023-GA-SEC-DSE dated 11th April, 2025.

Accordingly, the appeal succeeds in view of the changed circumstances.

The impugned order is set aside.

Thus, the appeal and the application are disposed of.

However, there shall be no order as to costs. 6.
