Mr. Soupal Chatterjee ...for the petitioners Mr. Arijit Ganguly Ms. Manisha Sharma ...for the State This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 323, 354, 448, 506 read with Section 34 of the Penal Code.
Let a copy of this application be served upon Mr. Arijit Ganguly and Ms. Manisha Sharma, learned advocates, who are present in court today and who ordinarily appear on behalf of the State.
Their engagement may be regularised in due course by the competent authority of the State.
Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case. The present case was started only to harass the petitioners. Although the FIR was lodged in 23.02.2020 and the charge sheet was filed in 29.06.2020, till date the proceeding could not be concluded. The
defacto-complainant is not appearing despite issuance of process on several occasions.
Learned counsel appearing on behalf of the State submits that there is no delay caused in the impugned proceeding. In a case started in February, 2020, already 6, out of 7 witnesses has been examined. 10th May, 2021 has been fixed for the next date of hearing.
I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition. No prejudice will be caused to any one if an order is passed in respect of an application for expeditious disposal of a proceeding.
It does not appear that there is any delay caused in the impugned proceeding. The trial has gone on at a reasonable pace. It is obvious that if any witness has not appeared for adducing evidence, appropriate steps would be taken by the learned trial Court in this regard. However, this Court is of the opinion that no further order need be passed in this revision. The revisional application is disposed of.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
