After the petitioners preferred an appeal before the learned Sessions Judge, 1st Court, Arambagh being Criminal Appeal No. 1 of 2024 an interim stay was granted on 20.01.2024. Thereafter on a few occasions due to unavoidable circumstances, the petitioners were constrained to pray for adjournment. But, the other side too had prayed for adjournments on many occasions. However, suddenly on 20.03.2025 the learned appellate court fixed a date for hearing of the appeal, but vacated the interim order granted earlier. It seems quite justified that the trial court would feel the need to pass an appropriate order if too many adjournments are taken as in the instant case.

However, the record reveals that the other side has also taken adjournments and on some occasion the work could not done due to resolution taken in the Bar.

In view of the above, the revisional application is disposed of by requesting the appellate court to hear out the appeal in accordance with law and at the earliest. The petitioners are granted liberty to file a fresh application for interim order before the appellate court which

shall be considered by the appellate court in accordance with law and expeditiously.
