Mr. Rudradipta Nandy Mr. S.B. Roy Chowdhuri ... for the State Learned counsel appearing for the petitioner submits as follows. Commercial quantity of contraband was seized from the co-accused of the petitioner. The only material available against the petitioner is the statement of the co-accused, which is inadmissible in evidence.

Learned counsel for the State relies on the case diary and submits that a prima facie case is made out against the petitioner. There are call detail recordings between the petitioner and the co-accused who was arrested with commercial quantity of contraband. The investigation is going on. On similar facts, anticipatory bail application of a co-accused was rejected by the Division Bench of this Court on 27.03.2025 in CRM(A) 936 of 2025.

In view of the call detail recordings between the petitioner and the co-accused who was arrested with commercial quantity of contraband and the order dated 27.03.2025 passed by a Division Bench of this Court in the case of similar circumstance co-accused, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail is rejected. (Jay Sengupta, J.)
