A direction to secure expeditious disposal of Title Suit Nos. 202 of 2017, 203 of 2017, 204 of 2017, 205 of 2017, and 206 of 2017, tried analogously pending before the learned Civil Judge (Junior Division), 2nd Court, Burdwan, is the ultimate relief sought for in this case.
Ms. Shila Sarkar, learned advocate appearing for the petitioners submits that all the suits referred hereinahove, except Title Suit No. 206 of 2017 are matured enough for peremptory hearing, and as regards 206 of 2017, an order has been there for payment of cost, and after deposition of cost, such suit may be posted for peremptory hearing.
The only contention expressed by the petitioners is against the delay caused in the disposal of the suits.
No other point is raised requiring address by this Court.
In view of the nature of the order proposed to be made in the case, no prior notice is considered to
be necessary.
Service upon the opposite parties is thus dispensed with.
Accordingly, learned Civil Judge (Junior Division) 2nd Court at Burdwan is requested to ensure expeditious disposal of suits, in connection with Title Suit Nos. 202 of 2017, 203 of 2017, 204 of 2017, 205 of 2017, and 206 of 2017, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.
Petitioners are directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties. With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
