This is a joint application for effecting compromise. The opposite party no. 2 is the de facto complainant who lodged a written complaint against the petitioner on the basis of which Howrah Police Station Case No. 550 dated 14.08.2012 under Section 3(1)(x) and (xv) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 corresponding to GR Case No. 5585/2012 pending before the learned Additional Sessions Judge, Special Court at Howrah and renumbered as SPL No. 149/2021. During pendency of the said case, the parties have effected a settlement out of Court. On the last occasion, the learned Public Prosecutor-inCharge was requested to obtain a report from the Officer-inCharge of Howrah Police Station after ascertaining the fact as to whether the de facto complainant compromised the petitioner voluntarily and free from any threat, coercion or undue influence. The Officer-in-Charge of Howrah Police Station has submitted a report with a written statement submitted by the de facto complainant that she voluntarily

settled the matter with the accused persons. Since the parties have dissolved their issues out of Court, the aforementioned proceeding be quashed. In view of such order, the learned Special Judge, Howrah is directed to record formal order of discharge of the accused person from the case. The report be kept with the record.
