1. The petitioner has applied for an electricity connection with the CESC after depositing necessary fees. The CESC tried to inspect the premises of the petitioner for considering the application for connection but was prevented by the private respondents.

2. Despite service of notice, private respondents are not represented.

3. It is now well settled that even a trespasser is entitled to electricity and subject to any proceeding that may be taken out against the consumer in accordance with law.

4. In those circumstances, the O. C., Lake Town Police Station shall extend necessary police help to the CESC and the petitioner for the purpose of carrying out inspection and also for accessing any portion of

the premises occupied by the petitioner for setting up of electricity connection if the same is in compliance of applicable rules of CESC.

5. It is expected that the inspection by the CESC is conducted within seven days from date and appropriate steps thereafter taken as expeditiously as possible.

6. The CESC and the petitioner shall also be assisted by the Lake Town Police at the time of grant of connection and/or installation of meter in the event the CESC is desirous of granting such connection.

7. The writ petition is disposed of.

8. In view of disposal of the writ petition, connection application being CAN 1 of 2024 is also disposed of.

9. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
