Let a copy of the application be served upon Mr. Suman De and Mr. Manoranjan Mahata, learned counsels, who ordinarily appear on behalf of the State. They are requested to represent the State in this case. Their engagement may be regularized in due course. Heard the learned counsel for the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. An FIR was started in the year 2017. A charge sheet was submitted in 2018. But, due to some miscommunication during the Covid period, the petitioner was not in a position to attend the proceeding. He surrendered on 05.02.2025 and prays for expeditious disposal of the proceeding. Incidentally, the petitioner had earlier been granted bail, failed to appear subsequently and a warrant of arrest was issued. The petitioner was again granted bail in the proceeding.

It appears that the case was started in 2017 and the petitioners have now surrendered for the 2nd time on 05.02.2025.

The explanation that during Covid period, there was some miscommunication and that is why the petitioner could not attend the proceeding is not quite acceptable because Covid period was only a small part of the entire pendency of the proceeding.

It does not appear that the petitioner can allege delay in conducting the proceeding because the delay was caused primarily because of non-appearance of the petitioner.

Be that as it may, it is expected that the learned trial Court would conclude the proceeding in accordance with law and as expeditiously as possible.

With these observations, the application is disposed of.
