Mr. Pravas Bhattacharyya along with Mr. Sandip Chakraborty, learned Advocates who usually appear on behalf of the State are requested to appear in this revisional application. Learned Legal Remembrancer, Government of West Bengal is requested to regularize the appointment of Mr. Pravas Bhattacharyya and Mr. Sandip Chakraborty, learned advocates in due course.

The learned Advocate on behalf of the State appears and submits that the revisional application is directed against an order passed in under Section 144 of the Cr.P.C. which is not in existence right now. So the revisional application has become infractuous. On careful perusal of the record, I find that the revisional application was directed against the order dated 29.1.2010 passed by the learned Executive Magistrate, Sadar Hooghly at Chinchura in M.P.Case No. 74 of 2010.

From the order itself I found that though it was passed on 29.1.2010 but it was not extended beyond sixty days within the meaning of proviso to Section 144(4) of the Cr. P.C. That apart in compliance with the order of this court, the petitioner did not take any steps and failed to submit any affidavit of service.

Considering all facts and circumstances of this case, the instant revisional application stands disposed of. (Bibhas Ranjan De, J. )
