Biswapti Paul v. The West Bengal State Electricity Distribution Company Limited And Others
17th May, (AK) W.P.A 7109 of 2022 Biswapati Paul Vs.
The West Bengal State Electricity Distribution Company Limited and others Mr. P.K. Pakrashi Mr. G. Das ...for the petitioner.
Mr. Debanjan Mukherjee ...for WBSEDCL.
It is fairly submitted by learned counsel for the petitioner, on instruction, that, due to non-payment of due electricity charges, the petitioner's electricity connection was cut by the WBSEDCL.
It is submitted by learned counsel that, despite the specific application of the petitioner bringing to the notice of the WBSEDCL that the electric meter was defective, no steps were taken thereon.
Learned counsel for the WBSEDCL submits that the initial bill was altered, upon proper calculations, when it was detected upon inspection that the electricity meter was defective, commensurate with the difference of readings between the new meter and the defective meter. Ultimately, the finally assessed dues are to the tune of Rs.2,18,966/-.
Since the petitioner is now willing to deposit the entire arrears to get back electricity connection, there is no use keeping the writ petition pending unnecessarily. Accordingly, WPA 7109 of 2022 is disposed of by directing the petitioner to deposit the arrear dues to the WBSEDCL, being to the tune of Rs. 2,18,966/-, along with expenses in accordance with law, including reconnection charges and disconnection charges, within June 1, 2022.
If so deposited, the WBSEDCL shall restore the electricity connection of the petitioner as expeditiously thereafter as possible, preferably within 48 hours from deposit of the entire amount by the petitioner. There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
