Petitioner has approached this Court being aggrieved by the inaction of the police authorities particularly with regard to the issue relating to egress and ingress.

State has submitted a report. Report reflects that a long standing dispute is existing. Initially, a case was registered at the behest of the petitioner in respect of certain injuries i.e. Duttapukur Police Station Case No.96 of 2022. On conclusion of investigation, police authorities submitted chargesheet No.500 of 2022 under the relevant provisions of the Indian Penal Code.

In spite of the criminal case having been registered, the dispute between the petitioner and the private respondents continued and presently what is reflected is that there is some obstruction in the free and fair movement through the common passage leading to the petitioner's house. Police authorities have also drawn up proceedings under Section 126 of the BNSS in view of certain hot altercations taken place between the petitioner and the private respondents.

It has also been brought to the notice of the petitioner relating to proceedings under Section 133 of Cr.P.C. Last of such order was passed on 27th January, 2025.

Be that as it may, without entering into the domain of any of the court, I direct the police authorities would ensure that there is no escalation of the bad blood existing between the petitioner and private respondents. If there are any obstructions created to the path leading to the house of the petitioner and/or illegal construction, the police authorities would direct the panchayat administration to take effective steps so that no inconvenience is caused to the petitioner.

With the aforesaid observations, WPA 7544 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
