AND In the matter of:- Subhajit Nandi ... petitioner Mr. Arijit Ganguly, Mr. Sanjib Kumar Dan ....for the State A report has been submitted by the Investigating Officer of the case which reflects that the complainant did not intend to proceed with the case and expressed her intention for withdrawal of the complaint. Consequently, the Investigating Officer had no other option except to file the report under Section 173(8) of the Code of Criminal Procedure with a prayer for discharging the accused person.
Report so submitted be kept with the record.
The present revisional application was preferred at a stage when the investigation was under progress.
Having regard to the change of circumstances, I am of the view that no interference is called for so far as the merits of the revisional application is concerned.
Accordingly, C.R.R.1036 of 2012 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
