IA No. CAN 1 of 2021 is an application for recalling and/or modification of the order dated April 21, 2021 passed by me in this Court.

I have heard learned Counsel appearing on behalf of the parties and I am satisfied, and accordingly, the order dated April 21, 2021 is recalled. Furthermore, the District Inspector of Schools (S.E.), Birbhum, being the respondent No. 3 is directed to consider the undated representation, being annexure 'P-3' at page 27 to this writ petition, upon granting an opportunity of personal hearing to the petitioner and thereafter pass a reasoned order within a period of eight weeks from the date of communication of this order. The reasoned order should be communicated to petitioner within a week from the date of passing such reasoned order.

With the above direction, the application is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the application are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat copy of the order, if applied for, be supplied to the petitioner on priority basis on compliance of necessary formalities.
