Petitioners complain that the respondents are attempting to grab the property of the petitioners and to that effect they have been threatening the petitioners by brandishing deadly weapons and when the same was resisted by the petitioners, they were subjected to severe assault.

Learned advocate appearing for the State submits a report. Report reflects that the petitioners and the private respondents are of the same locality and are cosharers of the same piece of land. The problem arose as both the petitioners and the private respondents each are claiming whole of the land irrespective of their shares. The dispute is completely civil in nature as there have been issues relating to demarcation of the land. Police authorities have already drawn up proceedings under

Section 126 of the BNSS for maintaining peace and tranquility.

In case the petitioners face inconveniences, petitioners would approach the jurisdictional Criminal Court. So far as the demarcation issue is concerned the jurisdictional Civil Court will decide the same. Police authorities have kept a vigil, they would continue their surveillance and ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting because of the strained relationship existing between the parties.

With the aforesaid observations WPA 7546 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
