IN THE HIGH COURT AT CALCUTTA

Item No.35 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 638 of 2013 Partha Pratim Chatterjee & Ors.

versus The State of West Bengal & Anr.

In Re: An Application under Section 482 of the Code of Criminal Procedure, 1973 filed in connection with Ketugram Police Station Case No. 228/2012 dated 18.12.2012 under Sections 353/384/379/427/323/34 of the Indian Penal Code.

Ms. Anasuya Sinha ... For the State.

The present revisional application has been preferred challenging the investigation in connection with Ketugram Police Station Case No. 228/2012 dated 18.12.2012 under Sections 353/384/379/427/323/34 of the Indian Penal Code.

The petitioners approached this Court in the year 2013 when the investigation of the case was in progress. No further persuasion was made in respect of this revisional application and the order dated 15.03.2013 reflects that the learned advocate appearing on behalf of the State, on instructions from the SDPO, Katwa, submitted that the investigation was to be completed within a period of two months. I have perused the report dated 10.03.2013 submitted by the SDPO, Katwa and I find that apart from the relevant sections which have been challenged in this revisional application, the investigation was also proceeding under Section 3 of SC/ST (Prevention of Atrocities) Act.

Having regard to the fact that this revisional application was preferred at the stage when the investigation of the case was in progress and the issues so raised in this revisional application relates to question of facts, I am of the opinion that no interference is called for at this belated stage. Accordingly, the revisional application being CRR 638 of 2013 is dismissed.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
